The nation's top law enforcement official, Pam Bondi, accepted Habba's resignation on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for the official to perform her duties.
"Do not interpret compliance for surrender," she declared. "My fight will now extend throughout the country."

The departure comes a week after a judicial panel determined that she had been serving in violation of the law as the federal prosecutor. This decision is likely to affect scores of legal proceedings in the state.
The appellate judges ruled that a acting appointment that did not receive the advice and consent of the Senate violated the Federal Vacancies Reform Act.

The Attorney General added that she will stay on at the justice department as a senior adviser. Habba plans to pursue additional appeals of the court's action, with hopes of a reversal.
